These Terms of Use describe the terms and conditions applicable to your accessand use of the websites, mobile sites, mobile applications and other portalsowned, operated, branded or made available by PakIranTrade.com (and itsprincipal company E-commerce Pvt. Ltd.) from time to time which relate to the PakIranTrade.com e-commerce platform, including but notlimited to: (a) the web and mobile-optimized versions of the websitesidentified by the uniform resource locator " PakIranTrade.com”; and (b)[the mobile applications of the PAKAARYA e-commerce platform . This document isa legally binding agreement between you as the user(s) of the Sites (referredto as "you”, "your” or "User” hereinafter) and the PakIranTrade.com and parent company entity determined inaccordance with clauses hereafter (referred to as "we”, "our”"site”, "Company” or " PakIranTrade.com” hereinafter).

Terms: Your access to and use of the Sites and PakIranTrade.comservices, software and products through the Sites, which shall include theplatforms of the Terms (such services, software and products collectivelyreferred to as the "Services” hereinafter) is subject to the terms andconditions contained in this document as well as the Privacy Policy and anyother rules and policies of the Sites that PakIranTrade.com may publish fromtime to time.
1.3 Electronic communication:
When you use our Services, or send e-mails, text messages, and othercommunications, from your desktop or mobile device to us, you may be communicatingwith us electronically. You consent to receive communications from uselectronically, such as e-mails, texts, mobile push notices, or notices andmessages on this site or through our other Services, such as our MessageCenter, and you can retain copies of these communications for your records. Youagree that all agreements, notices, disclosures, and other communications thatwe provide to you electronically satisfy any requirement that suchcommunications be in writing.

The compilation of all contentincluded in or made available through any of our Service is the exclusiveproperty of PakIranTrade.com, and its principal company, PAKAARYA, andprotected by international copyright laws.
1.5 Disclaimer:
You agree that (a) you will not copy, reproduce, download, re-publish, sell,distribute or resell any Services or any information, text, images, graphics,video clips, sound, directories, files, databases or listings, etc available onor through the Sites (the "Site Content”), and (b) you will not copy,reproduce, download, compile or otherwise use any site content for the purposesof operating a business that competes with PakIranTrade.com, or otherwise commerciallyexploit the site content. Systematic retrieval of Site Content from the Sitesto create or compile, directly or indirectly, a collection, compilation,database or directory (whether through robots, spiders, automatic devices ormanual processes) without written permission from PakIranTrade.com isprohibited. The use of any content or materials on the Sites for any purposenot expressly permitted in the Terms is prohibited.
By signing up, the user acknowledges that sharing of your account with other persons,or allowing multiple users outside of your business entity to use your account(collectively, "multiple uses"), may cause irreparable harm to PakIranTrade.comor its principal company, PAKAARYA, or other Users of the Site. Users shallindemnify PakIranTrade.com, its principal company, Pakaarya, our affiliates,directors, employees, agents and representatives against any loss or damages(including but not limited to loss of profits) suffered as a result of themultiple uses of your account. Users also agrees that in case of the multipleuses of your account or user‘s failure to maintain the security of youraccount, PakIranTrade.com and itsprincipal company, PAKAARYA shall not be liable for any loss or damages arisingfrom such a breach and shall have the right to suspend or terminate the user’saccount without liability to the user.
By signing up each user represents, warrants and agrees that (a) you have fullpower and authority to accept the Terms, to grant authorization and to performthe obligations hereunder; (b) your access and use the Sites and Services willbe for business purposes only; and (c) for users who are business entities, theaddress you provide when registering is the principal place of business of yourbusiness entity. For purposes of this provision, a branch or liaison officewill not be considered a separate entity and your principal place of businesswill be deemed to be that of your head office.
Each User represents, warrants and agrees that (a) you shall be solelyresponsible for obtaining all necessary third party permissions regarding anyUser Content that you submit, post or display; (b) any User Content that yousubmit, post or display does not infringe or violate any of the copyright,patent, trademark, trade name, trade secrets or any other personal orproprietary rights of any third party ("Third Party Rights”); (c) you havethe right and authority to sell, trade, distribute or export or offer to sell,trade, distribute or export the products or services described in the UserContent and such sale, trade, distribution or export or offer does not violateany Third Party Rights and (d) you and your affiliates are not the subjects ofany trade restrictions, sanctions or other legal restrictions enacted by anycountry, international organization or jurisdiction.
1.6 Privacy policy basic:
The company respects your privacy and permits you to control the treatment ofyour personal information. Additionally, on the issue of privacy, you herebyacknowledge that Company has the right to obtain certain identificationinformation about your computer and its operating system, including but notlimited to IP addresses for identification purposes without any further noticeto you. The abovementioned is to keep protected the users for any foreseeableissues.
1.7 User Content:
By posting or displaying any information, content or material ("UserContent”) on the Sites or providing any User Content to PakIranTrade.com or ourrepresentative(s), and to the extent permitted under applicable laws, you grantan irrevocable, perpetual, worldwide, royalty-free, and forward able (throughmultiple tiers) authorization to PakIranTrade.com, its principal company, PAKAARYAto display, transmit, distribute, reproduce, publish, duplicate, adapt, modify,translate, create derivative works, and otherwise use any or all of the UserContent in any form, media, or technology now known or not currently known inany manner and for any purpose which may be beneficial to PakIranTrade.com, itsprincipal company PAKAARYA., the operation of the Sites, the provision of anyServices and/or the business of the User. You confirm and warrant to PakIranTrade.com,that you have all the rights, power and authority necessary to grant the aboveauthorization. Information that is protected under data protection laws willonly be used and kept in compliance with those laws.
1.8 Refunds, cancellation & experience reimbursementpolicy
Nothing in this Agreement places a duty on Company to ever reimburse any usersby providing experience credit for any n lost for any reason. Company willnever reimburse or be obligated to reimburse users for any experience loss in amonetary manner non-monetary manner, such as but not limited to experiencereimbursements, monetary reimbursement or monetary credit, exceeding themonetary amount paid by the user.
1.9 Limited liability
The Company's liability to you is limited. To the maximum extent permitted bylaw, in no event shall Company be liable for special, incidental, orconsequential damages, lost profits, or lost data, regardless of theforeseeability of those damages arising out of or in connection with your useof the site or any other materials or services provided to you by company. Thislimitation shall apply regardless of whether the damages arise out of breach ofcontract, tort, or any other legal theory or form of action. Additionally, ourmaximum liability to you under all circumstances, whether in contract, tort orother otherwise, will be equal to the aggregate price you pay for our servicesover the course of your use of the site, after deduction of bank transactionfees and any taxes/duties already applied.

(b) Attempting to probe, scan, or test the vulnerability of the Service, theSite, or any associated system or network, or to breach security or authenticationmeasures without proper authorization;
(c) Interfering or attempting to interfere with service to any user, host, ornetwork, including, without limitation, by means of submitting a virus to theSite or Service, overloading, "flooding,” "spamming,” "mailbombing,” or "crashing;”
(d) Attempting to modify reverse-engineer, decompile, disassemble, or otherwisereduce or attempt to reduce to a human-perceivable form any of the source codeused by Company in providing the Site or Service. Any violation of system ornetwork security may subject you to civil and/or criminal liability.

The company has no control over, and no liability for anythird-party websites or materials.
